Myths vs. Facts: Direct Action Everywhere (DxE) activist Zoe Rosenberg’s false claims about the facts that led to her arrest, trial, conviction, and sentencing.
Myth 1:
Zoe Rosenberg was sentenced to 30 days in jail for rescuing four abused chickens.
Fact:
Rosenberg was convicted of felony conspiracy and three misdemeanors (two charges for trespass and one for vehicle tampering) – not theft. The case was about Rosenberg’s deliberate planning and execution of covert break-ins – using disguises, coordinated teams, and unauthorized access to private company systems – to disrupt a USDA-regulated facility. The incursion caused over $100,000 in operational losses and created biosecurity and food safety risks at the facility.
The jury unanimously rejected Rosenberg’s narrative, returning guilty verdicts on all counts. The evidence at trial showed coordinated, deliberate planning and an intent to disrupt a lawful, USDA-regulated operation. By contrast, no credible evidence, testimony, or records were presented to confirm any of Rosenberg’s claims about animal mistreatment.
Myth 2:
Zoe Rosenberg and her group entered the Petaluma Poultry Facility as an emergency rescue to save suffering animals.
Fact:
Rosenberg waited two months after her alleged discovery of abuse before acting, and her actions coincided with a pre-planned DxE event and her birthday. Despite claiming to have witnessed “horrific” conditions, Rosenberg never escalated through proper channels or notified relevant law enforcement or regulators. The operation was highly coordinated and extended well beyond animal welfare concerns, involving disguises, cutting fences, unauthorized access to private company data, and the installation of hidden cameras. No evidence or testimony of emergency conditions or animal mistreatment were presented at trial.
The District Attorney's office concluded that “planning, filming and rapid online publication reflected an intent to maximize exposure rather than respond to any verified emergency.”
Myth 3:
The rescued chickens were covered in wounds, parasites, and disease.
Fact:
No medical records, veterinary testimony, or credible photos supported these claims. Rosenberg produced photos of only two of the four stolen birds, and neither showed any feces, wounds, bruising, parasites, or visible illness consistent with her public statements. Rosenberg’s defense did not call any veterinarians to testify.
The District Attorney’s office concluded that “despite having ample personnel and resources present, she removed only four random birds, filmed herself doing so, and promptly used the footage to promote her organization’s broader agenda before embarking on a nationwide speaking tour.” Testimony at the trial confirmed that the goal of repeated incursions was content creation and publicity, not animal welfare.
Myth 4:
Chickens were being scalded alive at the facility.
Fact:
Rosenberg admitted under oath she never saw this happen and misunderstood basic USDA-required processing protocols as evidence of cruelty. No video, photos, hidden camera footage or expert testimony supported this claim. She mistook USDA-mandated red denaturant (a chemical used to mark inedible animal waste) applied to offal (organs and other inedible animal parts) for evidence of birds being “boiled alive,” despite large, labeled containers of denaturant being visible nearby – facts she admitted she never checked or investigated.
Myth 5:
Chickens were infested with toxic parasites and diseased.were being scalded alive at the facility.
Fact:
There was no medical evidence, testimony or results introduced to support any claims of disease, infection or parasite infestation. The defense declined to call any veterinary experts to testify.
Rosenberg and DxE operatives repeatedly misread and misrepresented internal records taken from the facility, demonstrating a fundamental lack of understanding of basic animal husbandry and poultry production. Their repeated references to Campylobacter were used to falsely suggest that birds were diseased or “battling infections.” In reality, Campylobacter is a commonly occurring microbe in otherwise healthy poultry and is not an indicator of illness, suffering, or impaired development in birds.
Myth 6:
DxE’s investigation was validated by experts and hidden camera evidence.
Fact:
No expert testimony or hidden camera footage presented at trial supported Rosenberg’s claims about the condition of these birds. Two veterinarians were listed by Zoe Rosenberg as part of her defense, but neither was called to testify. One was her mother (a vegan activist supported by DxE), and the other was a veterinarian who examined one of the taken birds but was not ultimately called by the defense.
Myth 7:
The prosecution was based on just $24 worth of chickens.
Fact:
Rosenberg was not charged with theft, and the financial impact was not about the value of the birds, but the operational disruption and biosecurity hazards caused by the incursion. The facility incurred over $100,000 in losses due to the resulting shutdown and emergency measures. While the financial losses are significant, any funds received by court-ordered restitution will be donated back to the Sonoma County community to fight food insecurity.
Myth 8:
Zoe Rosenberg is being punished for whistleblowing.
Fact:
Rosenberg was not charged, tried, or convicted under any whistleblower law, nor was whistleblowing alleged at any point in the legal process. The court record shows her actions were a coordinated, unlawful PR campaign. The jury unanimously convicted her on all counts, including a finding that the conspiracy involved deliberate planning and sophistication.
Myth 9:
Rosenberg’s actions were justified by a legal opinion.
Fact:
The cited legal opinion, which relied on unverified claims of animal cruelty and reflected a private activist’s interpretation, not a genuine court ruling or law, is not applicable to the facts or the facility in question. California law does not allow private citizens to trespass, breach biosecurity, or remove animals from USDA-regulated facilities based on unilateral judgment.
Myth 10:
Rosenberg regrets her actions and is remorseful.
Fact:
Since her sentencing, Zoe has said she does not regret her actions and instead is encouraging more theft and illegal activity by DxE operatives.
While she has been in jail, activists are continuing to steal animals in support of DxE’s extreme agenda and to date have stolen beta fish, chickens, rats, raccoons, mice and birds from unnamed facilities.
